READ BEFORE SIGNING. This agreement concerns indoor electric go-kart activities and associated use of the track, equipment, and facility. It affects legal rights, including certain claims based on ordinary negligence. A parent or legal guardian must sign for each minor before participation.

Participant and visit details

1 Parent authority and consent

I am at least 18 years old and am this child’s parent or legal guardian, with authority to give this consent. I authorize the child identified above to participate during the visit identified above. Signing this agreement does not guarantee eligibility to ride; Kart City staff must confirm applicable rider requirements and equipment fit. An accompanying adult who is not the child’s parent or legal guardian may not sign this agreement on that basis alone.

2 Acknowledgment and assumption of risks

I understand that electric go-kart activities involve risks even at low speeds and when safety rules are followed. These include collisions with karts, barriers, or fixed objects; sudden acceleration, braking, or turns; loss of control; equipment or restraint failure; mistakes by riders or staff; and slips or falls when entering or leaving a kart or moving around the facility. Injuries may include bruises, sprains, fractures, head or neck injuries, permanent disability, or death. Helmets, restraints, supervision, and barriers reduce risks but cannot eliminate them. I understand these risks, will explain the rules to the child in an age-appropriate way, and voluntarily consent to participation and assume the associated risks to the extent permitted by law.

3 Safety and fitness for participation

The child must follow the safety briefing, posted rules, and staff instructions; use required protective equipment and restraints; keep hands and feet inside the kart; and avoid intentional contact or unsafe driving. I will tell staff before participation about any condition affecting safe operation and will seek medical advice if fitness is uncertain. I will not permit participation while impaired or when a condition makes participation unsafe. Staff may stop a session or deny participation for safety reasons. I will remain available during the child’s visit.

4 Release of liability for ordinary negligence

In consideration of permission to participate, I, individually and on behalf of the child to the extent I have legal authority and Indiana law permits, release and agree not to sue KartCity LLC, its members, managers, officers, employees, and agents, and the owners and lessors of the premises (the Released Parties), for claims arising from this visit’s go-kart activities or associated use of the facility, including personal injury, death, property damage, and related losses CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. This expressly includes ordinary negligence in supervision, instruction, operation, inspection, maintenance, equipment selection, and the condition of the track or premises. I also release my own related claims, including medical expenses and loss of services, to the extent permitted by law. This agreement does not release gross negligence, reckless or willful or wanton misconduct, intentional wrongdoing, or any liability that cannot lawfully be waived.

5 Emergency assistance

If the child needs emergency assistance, I authorize staff to contact emergency services and provide assistance within their training. If I cannot be reached promptly, I consent to emergency evaluation and treatment by qualified medical providers as permitted by law. I remain responsible for medical charges for which I am legally liable; this provision does not waive claims excluded from the release above.

6 Scope and applicable law

This agreement applies only to the child and visit identified above, including races within that visit. Indiana law governs. If any provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. This agreement does not replace Kart City’s safety obligations or liability insurance. No consent to promotional photography or marketing messages is included.

7 Electronic signature and acknowledgment

I have read this entire agreement, understand its effect, and have had the opportunity to ask questions before signing. I voluntarily consent to the child’s participation. I understand that I am releasing certain legal rights, including claims based on ordinary negligence, subject to the limits stated above.

By affirmatively selecting the acknowledgments and signing below, I intend my electronic signature to authenticate this agreement. A copy will be available to download after signing. Keep the private receipt link to access it again. If I do not consent to electronic signing, I may contact Kart City to arrange a paper signature before participation.
